Whether a designer, contractor, building owner or tenant, you have a duty of care to your employees and those working on your property. You are obliged to ensure any work activity can be carried out safely—minimising risk.

Falls from height are the biggest cause of death and injury in building maintenance and construction, and so is one of the greatest hazards in the built environment.

One part of minimising risk is determining the correct level of competency for the individual(s) expected to undertake the work activity and ensuring that only individuals capable of demonstrating such a level of competency, or beyond, be permitted to undertake the work activity.

The importance of individual competency is underpinned by the Health & Safety at Work Act 1974 which states that it is a legal requirement for employers to provide.

It is therefore imperative that individuals are not exposed to hazards that they are incapable of recognising or unable to manage. If this were to happen, employers would be in breach of the legislation which is a criminal offence punishable by fines, prison or both. Individuals, as well as companies, can be charged for breaches of safety legislation.
